成功为陈某某争取到从轻量刑情节。该案中,陈某某因陪同他人销赃盗窃所得财物,被指控涉嫌掩饰、隐瞒犯罪所得罪。田洁律师团队介入后,通过细致梳理资金流向、分析陈某某的主观认知状态,结合其认罪认罚情节及主动退赃退赔的表现,向法院提交详尽法律意见书,论证陈某某缺乏明知是犯罪所得而予以掩饰、隐瞒的主观故意,最终法院采纳辩护意见,对陈某某作出从轻处理。案件办理结束后,田洁律师团队总结承办经验,撰写《掩饰隐瞒犯罪所得罪的主观故意与案例分析》(入选2024年度四川省律师协会刑事辩护协会论文集)。
为张某某涉嫌偷越国(边)境罪、诈骗罪一案提供全程辩护。张某某受他人蛊惑偷渡至境外,后被指控参与电信网络诈骗活动。田洁律师自侦查阶段即介入案件,通过多次会见张某某核实案情,发现其在境外期间系被胁迫从事辅助性工作,并未直接实施诈骗行为,且偷越国(边)境情节显著轻微,同时具备初犯、偶犯、认罪认罚、自首等从轻、减轻量刑情节。辩护过程中,田洁律师重点厘清偷越国(边)境罪与诈骗罪的罪数关系,针对偷越国(边)境罪的构成要件提出证据不足的辩护观点,同时积极协调退赔事宜。最终,法院对张某某所涉诈骗罪从轻判处,偷越国(边)境罪因证据不足未予认定。
为邓某某涉嫌帮助信息网络犯罪活动罪辩护并取得良好效果。邓某某是刚离异、独自抚养孩子的女性,因轻信网络兼职信息,将本人多张银行卡提供给他人使用,涉案流水金额巨大。田洁律师充分考量邓某某的特殊身份及案件的社会危害性,在辩护中着重指出其系被诱骗参与、实际获利微薄、认罪悔罪态度诚恳、初犯、偶犯等情节,同时协助她完成退赃及认罪认罚程序。通过有效沟通,法院最终对邓某某适用缓刑,使其能够继续抚养年幼的女儿、照顾年迈的父母,实现了法律效果与社会效果的统一。

Ms. TIAN Jie is a Senior Partner of Sichuan Chihkao Law Firm. She serves as Director of the Low-Altitude Economy and General Aviation Professional Committee and Deputy Director of the Silver Economy and Age-Friendly Industries Professional Committee. She is also qualified as both a Senior Enterprise Compliance Specialist and a Performing Arts Agent. With strong professional expertise, Ms. TIAN has been selected for the Foreign-Related Lawyers Pool of the China International Lawyers Training Center, the Reserve Talent Pool for Foreign-Related Legal Services of Sichuan Province, and the Foreign-Related Lawyers Talent Pool of Chengdu City. Represented Mr./Ms. SHU in a case involving the unlawful disclosure of his/her personal privacy. Ms. TIAN’s team initially filed a criminal complaint against the alleged offender, Mr./Ms. HUANG. After the public security authorities imposed administrative detention on Mr./Ms. HUANG and further criminal proceedings became impractical due to evidentiary constraints beyond the client’s control, the team strategically pursued parallel civil remedies. Through subsequent civil litigation, they secured additional financial compensation for the client, effectively protecting his/her legitimate rights and interests through a coordinated civil and criminal legal strategy.
Represented a property management company in criminal proceedings against an employee suspected of embezzlement in office. Ms. TIAN’s team, acting as the company’s attorney, filed a criminal complaint against the employee. Throughout the investigation, Ms. TIAN’s team participated extensively in evidence review and legal analysis. The team conducted a thorough examination of the company’s financial records, fund transfers, and business contracts to establish a complete evidentiary chain and substantiate the amount involved under the applicable legal standards. During the preliminary investigation by the public security authorities, the team submitted multiple written legal opinions addressing key issues, including the constituent elements of the offense, the suspect’s capacity as a company employee, and the intent of unlawful appropriation, assisting the investigating authorities in accurately characterizing the case. In response to the suspect’s defense that the dispute was purely civil in nature, the team systematically distinguished the relevant employment and agency relationships and demonstrated that the conduct constituted criminal embezzlement through the abuse of occupational authority. The representation ultimately enabled the company to recover misappropriated assets and maximize the protection of its property interests.
Represented a leading car rental company in filing a criminal complaint against a senior executive suspected of embezzlement in office. Through coordinated legal representation before the judicial authorities, Ms. TIAN’s team successfully recovered all misappropriated assets, enabling the company to recoup its losses in full.
Successfully secured a reduced sentence for Mr./Ms. CHEN in a case involving the alleged offense of concealing or disguising the proceeds of crime. Mr./Ms. CHEN was charged after accompanying another individual in disposing of property obtained through theft. Following their engagement, Ms. TIAN’s team conducted a detailed review of the fund flows and carefully analyzed Mr./Ms. CHEN’s state of mind at the relevant time. Taking into account his voluntary guilty plea, acceptance of punishment, and proactive restitution and compensation, the team submitted a comprehensive legal opinion arguing that Mr./Ms. CHEN lacked the requisite knowledge that the property constituted criminal proceeds and therefore did not possess the requisite criminal intent to conceal or disguise such proceeds. The court ultimately accepted the defense’s arguments and imposed a more lenient sentence. Following the conclusion of the case, Ms. TIAN’s team prepared a scholarly paper entitled Criminal Intent in the Offense of Concealing or Disguising the Proceeds of Crime: A Case Study, which was selected for inclusion in the 2024 Criminal Defense Committee Papers Collection published by the Sichuan Lawyers Association.
Represented Mr./Ms. ZHANG throughout criminal proceedings involving allegations of illegal border crossing and telecommunications fraud. Mr./Ms. ZHANG had been persuaded by others to leave China illegally and was subsequently accused of participating in a telecommunications fraud scheme overseas. Ms. TIAN became involved at the investigation stage and, through multiple client interviews and a thorough review of the facts, established that Mr./Ms. ZHANG had been coerced into performing only ancillary tasks while abroad and had not directly engaged in fraudulent activities. The defense further demonstrated that the circumstances surrounding the illegal border crossing were relatively minor and that Mr./Ms. ZHANG qualified for several mitigating factors, including being a first-time offender, committing an isolated offense, voluntarily pleading guilty, accepting punishment, and surrendering himself to the authorities. During the defense, Ms. TIAN focused on distinguishing the legal relationship between the offenses of illegal border crossing and fraud, challenged the sufficiency of the evidence supporting the illegal border crossing charge, and actively assisted in arranging restitution. The court ultimately imposed a mitigated sentence on the fraud charge and declined to convict Mr./Ms. ZHANG of illegal border crossing due to insufficient evidence.
Represented Ms. DENG, who was charged with the offense of assisting information network criminal activities, achieving favorable results. Recently divorced and solely responsible for raising her young child, Ms. DENG had been deceived by an online part-time job advertisement into allowing others to use several of her bank accounts, resulting in substantial transaction volumes linked to the case. In presenting the defense, Ms. TIAN emphasized Ms. DENG’s personal circumstances and social harmfulness of the case, and demonstrated that she had been misled into participating, had received only minimal financial benefit, had shown genuine remorse, voluntarily pleaded guilty, and accepted punishment, was a first-time offender, and committed an isolated offense. The defense also assisted her in completing restitution and the formal plea process. Through effective advocacy and communication with the court, Ms. DENG was ultimately granted a suspended sentence, enabling her to continue caring for her young daughter and elderly parents while achieving an appropriate balance between the objectives of criminal justice and broader social considerations.
